These terms are an agreement between you and SulfurByte ("we", "us") covering your use of Dayshot - My Photo Journal ("Dayshot", "the app"). By installing or using Dayshot you agree to them. If you don't agree, don't use the app.

1. Using Dayshot

We grant you a personal, non-exclusive, non-transferable, revocable license to use Dayshot on Android devices you own or control, for your own personal use, subject to these terms and Google Play's terms. You may not copy, modify, distribute, sell, or lease any part of the app, reverse engineer it except where the law permits, or use it in any unlawful way. The photos and text you put into your journal are yours; these terms give us no rights to them.

2. What Dayshot does and doesn't promise

Dayshot is a personal photo journal that stores everything locally on your device. It is not a cloud service: there are no accounts, and your journal is not synced or stored anywhere else. That means if your device is lost, damaged, or reset, or you uninstall the app or clear its storage, your journal is gone and we have no way to recover it. The app includes a Backup feature; creating backups regularly and keeping the backup files somewhere safe is your responsibility. We do not guarantee that the app will be uninterrupted or error-free.

3. Dayshot Pro

  • Dayshot offers an optional one-time purchase, Dayshot Pro, which permanently unlocks the additional features shown in the app. It is not a subscription and nothing renews.
  • Billing is handled by Google Play. The price is shown before you buy.
  • The purchase is tied to the Google account you bought it with. If you reinstall the app or switch devices, it is restored through Google Play on the same account, automatically or via "Restore purchases" in the app. The purchase does not transfer your journal data between devices; use the Backup feature for that.
  • Refunds are governed by Google Play's refund policy.

4. Your data

Dayshot stores its data locally on your device and collects nothing about you, see the Privacy Policy, which is part of these terms.

5. Changes to the app and these terms

We may update, change, or discontinue features of Dayshot at any time. We may also update these terms; the current version will always be posted at this address with its "last updated" date, and for material changes we may also notify you in the app. Continuing to use Dayshot after a change means you accept the updated terms.

6. Termination

You can stop using Dayshot at any time by uninstalling it. We may suspend or terminate your license if you materially breach these terms.

7. Disclaimer of warranties

Dayshot is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Your statutory rights as a consumer are not affected by this section.

8. Limitation of liability

To the maximum extent permitted by law, SulfurByte is not liable for any indirect, incidental, special, or consequential damages, or loss of data or profits, arising from your use of (or inability to use) Dayshot. Our total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law.

9. Governing law

These terms are governed by the laws of the Czech Republic. If you are a consumer, this does not deprive you of protections granted by mandatory laws of your country of residence.
